OBLIGATIONS OF THE PERSONS PLACING VEHICLES ON THE MARKET BEFORE ENVIRONMENTAL LAW

ECOBULCAR JSC is a recovery organization for end-of-life vehicles, which assumes the obligations of the persons placing vehicles on the market, offering an economically acceptable, effective and long-lasting solution implementing the objectives laid down by environmental law.

 

WASTE MANAGEMENT ACT (WMA) Art. 11

Art. 11. (1) The persons placing on the market products, whose use generates widely distributed waste, specified by the provisions pursuant to Art. 24, para. 2, shall be responsible for their separate collection and achievement of the respective objectives for recycling and recovery.

REGULATION ON THE REQUIREMENTS FOR TREATMENT OF END-OF-LIFE VEHICLES

Art. 21. (1) The economic operators, depending on the subject matter of their business, shall be obliged to ensure the acceptance of the overall amount of end-of-life vehicles (in tons), equal to overall amount of end-of-life vehicles (in tons), generated during the current year.

(2) The amount of end-of-life vehicles (in tons), which any person placing vehicles on the market shall be obliged to collect for the purpose of achieving the objectives pursuant to Art. 3, shall equal the part of the overall amount of vehicles with terminated registration for the respective calendar year According to Art. 18 of Regulation No I-45 of 2000 which has been accepted at dismantling centres and/or collection and temporary storage sites (in tons), corresponding to this person's market share of the total amount of vehicles placed on the market during the current year."

Art. 35. (1) The persons placing vehicles on the market may implement their obligations for achievement of the respective objectives pursuant to Art. 21 for the collection, reuse, recovery and recycling of the ELV they have placed oon the market by a collective system pursuant to Art. 11, para. 4, point 2 of the WMA.

(2) The collective system under para. 1 shall be represented by a recovery organization having a license issued under the terms of Chapter five, Section IV of the WMA.

(3) The persons who have signed a contract with a recovery organization under para. 1 shall be considered as implementing their obligations through a collective system.

DECREE DETERMINING THE TERMS AND AMOUNT OF PAYMENT OF PRODUCT FEE FOR PRODUCTS, WHOSE USE GENERATES WIDELY DISTRIBUTED WASTE

Adopted by CoM Decree No 120 of 30.05.2008, prom. SG, issue 53 of 10.06.2008

Art. 1. (1) The persons who place on the Bulgarian market products, whose use generates widely distributed waste, as well as the persons who acquire vehicles for their personal use as a result of vehicle introduction on the country's territory from another EU member-state or from a state outside the EU, shall pay product fee under the terms and in the amount, specified by the Decree.

(2) The persons who place on the Bulgarian market products, whose use generates widely distributed waste, are the producers, importers and persons introducing on the country's territory from another EU member-state or from a state outside the EU the respective products and submitting them to another person against payment or free of charge, and/or using them as part of a commercial, industrial or professional activity with the purpose of distributing or using the product on the territory of the Republic of Bulgaria.

(5) Product fee shall be paid for:

2. vehicles of categories L2, L4, L5, L5e, М1 and N1 under the terms of Art. 149, point 1, letters "c", "g", "i" and "j", point 2, letter "а" and point 3, letter "а" of the Traffic Act according to Annex No 2;

(6) Product fee under para. 1 shall not be paid for:

1. vehicles of categories L2е and L4е under the terms of Art. 149, point 1, letters "d" and "h" of the Traffic Act;

2. vehicles intended for special purposes under the terms of Annex No 1, Part А, point 5 of Regulation No 60 of 2003 approving the type of new vehicles and their trailers (SG, issue 59 of 2003);

Art. 3. (1) During the initial registration of a vehicle, its owner shall also submit to the Traffic Police Department of the Police Metropolitan Directorate or to the respective Police District Directorate the following documents:

A declaration according to Annex No 8 (to the regulation), prepared by the person who places vehicles on the market, or by a person authorized by him, and a copy of a certificate issued by a recovery organization for ELV.

ECOBULCAR JSC implements its obligations under the contract with its members against payment of a contribution to the Organization, amounting to 80 % (eighty percent), VAT excluded, of the product fee for the vehicles under Annex No 2 to Art.1, para. 5, point 2 of the Regulation determining the terms and conditions for payment of product fee for products whose use generates widely distributed waste for each vehicle placed on the Bulgarian market.
